During an April gig in New York City at Brownie's, Smith was in rare form. The band played large parts of the set with Smith offstage, at one point Smith said something to Karl Burns that made him jump over his drum kit and attack the singer, and Crooks and Smith were at odds the whole show with Crooks kicking Smith and Smith flicked lit cigarettes at Crooks. Burns, Crooks, and Steve Hanley were out of the band and Smith spent a night in jail on assault charges. The live and outtake CDs kept coming and Smith released his first spoken word album, The Post Nearly Man, in September.
